Assalam o Alaikum
Here we have mutually agreed on separation although I have initiated this and then the both families Punchayat involved and we returned Dowry articles even a single bangle and they assured us they will have no issue regarding visiting my son and they also write this statement and my spouse also submitted stamp paper and Dowry articles and these happend under video recording and they successfully gained all their dowry articles and other stuff peacefully but here is situation completely changed now after one month we approach just to visit son that is one year old they completely denied and when we ask the meditatators to look into they even threatened them they will not allow us at any cost to meet our son and as I have also sent 5k interim maintenance to spouse account so how can I get joint custody because the family has anger management issues and they are now stubborn so please guide the legal procedures I can't trust them but here in Pakistan law favours women because they cry they weep and all drama so called educated how we can proceed with our son custody or even visiting rights

In response to above, note that even though both families agreed on separation, dowry was returned and statements were recorded. These things do not create enforceable custody or visitation rights because custody and visitation are always decided by the Guardian Court under the Guardian and Wards Act, not by family mediation. Courts look at the conduct of both parents. If the mother or her family blocks a father from meeting without lawful justification, it goes against the child’s welfare. Courts don’t appreciate hostility and threats. Sending maintenance to her account is important and t shows responsibility. File a guardian petition and declare visitation rights (weekly or fortnightly meetings + video calls) file a petition for interim custody along with aforesaid main petition. Thanking you, Ch.
