"If I received one divorce notice and then do not accept the next divorce notice, what will happen legally?"

In Pakistan

Last Updated: Nov 6, 2023

"I am a woman, and I have a 1-year-old son. Due to some minor conflicts, I moved to my mother's house, and my husband, who lives in another country, sent me a divorce notice. My uncle initially suggested that we would pursue child custody in court. However, he now advises me not to accept any further divorce notices delivered by the postman. I want to know if not receiving these notices will be helpful for my case in court. I don't wish to return due to my husband's and in-laws' behavior."

for divorce, your husband have to send two notices one for you and one for Union Council and if you receive or not that doesn’t matter because the Notice already delivered to you and the Notice deliver to uni Union Council they will also issue a notice to you to appear on a date fixed by Union Council re-conciliation committee. Okay so if you want to reconcile with your husband you can join the reconciliation proceedings in Union Council are you can also contact Union Council otherwise the people will issue divorce certificate after completion of 90 days.

The legal validity of a divorce notice is not contingent upon the recipient's acceptance or refusal of subsequent notices. Receiving one divorce notice at a specific address satisfies the legal requirements. Refusal to accept additional notices does not confer any rights in favor of the recipient, nor does it diminish any existing rights. In accordance with the law, distinct rights are delineated and enforced accordingly. The effectiveness of the divorce takes place after a period of 90 days from the issuance of the initial divorce notice. The legal process of divorce in Pakistan involves specific procedural steps that must be followed. Consequently, the act of refusing to accept remaining divorce notices does not yield any legal consequences.

it's important to note that legal matters can be complex, and the outcome can depend on various factors, including the specific circumstances of your case and the laws applicable in Nigeria or any other jurisdiction. However, we can provide you with some general information applicable to Nigeria and some other jurisdictions.

If you receive a divorce notice and choose not to accept or respond to the next divorce notice, it may have legal consequences. In legal proceedings, parties are typically given an opportunity to respond to notices and present their case. Failure to respond may result in the court proceeding in your absence, and a judgment may be issued based on the information available.

In the context of a divorce, not responding to a divorce notice could potentially lead to the court granting the divorce in your absence. This may have implications for issues such as the division of property, spousal support, and child custody if applicable.

It is highly advisable to consult with us to discuss the specifics of your situation and receive personalized legal advice. We can guide you on the best course of action based on the laws and regulations in Nigeria and help protect your legal rights and interests.
