Annulment

In Philippines
Last Updated: Feb 15, 2026
I would like to inquire about the usual timeline for filing an annulment case. I engaged a lawyer in April 2025, and while I have already completed payment of the professional fees and the psychologist’s fees, the petition has not yet been filed and my witnesses have not yet been interviewed.
I was also unable to provide a witness from my husband’s side since they are unwilling to participate. May I ask if this situation could affect the filing of the case?
Is it normal for the filing process to take this length of time? I would appreciate your guidance and clarification.

The preparation of an annulment petition may take some time because the lawyer usually needs to gather documents, coordinate with the psychologist, prepare the judicial affidavit of the parties and witnesses, and ensure that all requirements are complete before filing the case in court. However, the exact timeline may vary depending on the circumstances and readiness of the supporting documents and witnesses. The absence of a witness from your husband’s side does not necessarily prevent the filing of the petition, as annulment cases may proceed based on the testimony of the petitioner and other available witnesses. If you would like us to properly assess your situation and provide clearer guidance on next steps, we recommend scheduling a consultation or visiting our office to review the details of your case.
