Dapat and Dapat Lawyers: We would like to answer your query. Under the Philippine law on family cases, the surviving parent (which in this case, the mother) shall have custody over the children. Unless the mother is unfit to have custody and further considers the best interest of the children. In this particular query, if we can prove that indeed the mother is unfit you can file for full custody over your grandchildren.
