Do I have a valid cause of action against the [company removed] franchise for non-return of investment funds that I invested for 6 years, and what legal basis applies (e.g., estafa, breach of contract, violation of the Securities Regulation Code)?

I invested 300K pesos in one of the [company removed] franchisers in 2019, over 6 years ago. The contract is for 5 years, and since it was already ended, I sent a demand letter to withdraw my investment. Before that, I also sent several emails informing them of my intent to withdraw my investment. But I did not receive any response, and all my emails were completely ignored.

Thank you for your question.

Yes you have a valid cause of action, based on your information. You have 2 options to consider:

1. Check with the SEC if the company is authorized to accept investments from the public.
2. File a case in court for specific performance with damages for breach of contract.

Thank you.
