A pre-litigation demand letter in Poland should be short, factual, and clearly set out what you expect the neighbour to do. Begin with a polite opening that identifies you (full name and address) and the neighbour (address of the property causing the disturbance). Briefly describe the problem – e.g., “Since [date] you have repeatedly played loud music after 22:00, which disturbs the peace of my household.” Reference the relevant Polish regulation (Art. 144-149 of the Civil Code and local municipal noise ordinances) that obliges neighbours to refrain from conduct that interferes with the peaceful enjoyment of one’s property. State the specific remedy you are requesting – for example, “Please cease playing music louder than 50 dB after 22:00 and limit volume to a reasonable level within 48 hours of receiving this letter.” End with a clear consequence: “If the disturbance continues, I will be forced to lodge a complaint with the local police and/or initiate civil proceedings for nuisance, seeking damages and an injunction.” Sign the letter and include your contact details for any response. To prove receipt, send the letter by registered mail with return receipt (poczta polecona z potwierdzeniem odbioru), which provides an official acknowledgment signed by the recipient. Keep the receipt and a copy of the signed acknowledgement as evidence. As a backup, you can also deliver the letter in person and have a neutral witness sign a hand-delivery receipt (potwierdzenie doręczenia) or use a reputable courier that offers tracking and proof-of-delivery. Retaining copies of the envelope, tracking screenshots, and any electronic confirmations will strengthen your position if you later need to demonstrate that the neighbour was properly notified.
