Hi, it's a very long story, but the main thing is that my brother changed my mother's will, and she has alzheimers. She remembered that she signed something, but didn't know what. My brother demands that she go to the bank. He pushed her in a wheelchair and closed her bank account. My money was still in her account. My brother swears at me when I talk to him about everything. I can't keep quiet anymore. I sit with the last will and a paper that states: nobody change my will. My brother was not part of our lives, and when he heard the word money then he was there. It took me 3 years to open my mouth. There is more to the story. I have some letters here from her as evidence.e I just want an affordable lawyer that will listen because I knew I would win the case. Can somebody just guide me, please

Hello:

Thank you for sharing this with me. From what you narrated, assuming this involves Philippine Citizens, your situation involves serious legal issues that may fall under Philippine laws if your family and properties are situated here. Based on your story, a.) the fact that your mother has Alzheimer’s raises the question of whether she had full capacity to understand the documents she signed. Under our Civil Code, for a will to be valid, the testator must be of sound mind at the time of execution. If she was not, then the will may be contested for lack of testamentary capacity. b.) If your brother manipulated her into signing papers or closing accounts against her free will, that could amount to undue influence, intimidation, or even fraud, which are valid grounds to question or annul such transactions. c.) With regard to the money you deposited in her account, ownership can be proven with receipts, letters, or any proof that it was yours and not part of her estate. You may recover that through a claim in court.

Since you mentioned you already have letters and some written evidence, that would be very helpful in filing the appropriate petition or complaint. We can assist you in preparing either a petition to declare the will invalid, or an action to recover your rightful money and assets, while also protecting your mother’s estate from being misused.
