Request for Consultation – Property Dispute and Unlawful Actions by Landlord
I am seeking legal assistance regarding a property dispute currently before the Johannesburg Magistrate’s Court. The Plaintiff has issued summons against me for alleged arrears and eviction.
However, prior to the summons, the landlord engaged in a series of unlawful actions between August and October 2025, including:
• Removing doors and cutting off water and electricity supply,
• Failing to maintain basic facilities such as the toilet,
• Locking me out of the premises on 15 September, forcing me to sleep outside,
• A spoliation order was granted on 16 September restoring my possession.
Despite these events, the Plaintiff’s summons only refers to arrears and a cancellation notice in November, omitting the unlawful conduct that directly prejudiced me.
I have already served a Combined Notice in terms of Rule 23(1) and Rule 55(1)(b) to demand particulars and documents. The Plaintiff has acknowledged receipt but has not yet complied.
