Can I appeal a UAE civil judgment after missing the deadline due to travel?

I received a civil court judgment in Dubai, but I was outside the UAE and only saw the notice after the appeal period ended. Is there any way to request an extension or file a late appeal based on valid reasons, and what documents would I need?

It depends on the nature of the judgment. If the judgment was attended (meaning you or a lawyer representing you appeared in any of the hearings), then unfortunately it is not possible to appeal after the legal deadline has passed, even if you were outside the UAE. However, if the judgment was in absentia (default judgment) and neither you nor any legal representative attended any hearings, then you may still have the right to file an opposition against the default judgment, which would allow the case to be reconsidered before the same court.

Thank you for your message. In some situations, it may be possible to request reconsideration or explore limited avenues for late appeals in the UAE if there are valid reasons for missing the deadline, such as being outside the country or not receiving proper notice. The exact options and required documents depend on the specific judgment and circumstances.

In the UAE, appeal deadlines are strict (usually 30 days for civil cases), but if you missed the deadline due to valid reasons such as being outside the UAE and not properly notified, you may be able to file a grievance, request reinstatement, or file a nullity action (depending on the case and notification method).

If you were not properly notified or the judgment was issued in your absence, you may have options such as:

\n
    \n
  • Filing an opposition to judgment in absentia
  • \n
  • Filing a nullity case due to improper notification
  • \n
  • Requesting the court to reopen the appeal period in certain circumstances

You will typically need:

  • Passport and travel proof (entry/exit records)

  • Court judgment copy
  • \n
  • Notification documents

  • Emirates ID

These cases are very time-sensitive, so you should take legal advice immediately.

Yes, in the UAE it may still be possible to take action even if you missed the appeal deadline, but this depends on the reason for the delay and how the judgment notification was served. Under UAE Civil Procedure Law, appeal deadlines are strict (usually 30 days for civil cases), but in some situations you may be able to file a petition to reopen the time limit or challenge the judgment if: You were not properly notified; The judgment was issued in your absence; There was a valid excuse such as travel, medical emergency, or force majeure; There was procedural error in notification. In some cases, instead of a normal appeal, the lawyer may file: Petition for reconsideration; Nullity case; Objection to judgment in absentia; Request to reopen appeal deadline due to improper notification. Documents usually required: Copy of judgment; Emirates ID / Passport; Travel proof (entry/exit report, passport stamps, tickets); Proof you did not receive proper notification; Case documents and court notices; Power of Attorney for lawyer. Timing is very important, so you should act immediately because delays can limit your legal options.
