As per the mentioned details, your friend can divorce her through the Court and in case he don't need the custody of the baby , she can have the baby. As per the case goes, he can divorce her.

If the marriage is legally registered in the UAE, it remains valid until a court grants divorce — even if both initially agreed to separate later. If one party changes their mind, the other can still file for divorce through the Family Court, and the court will decide based on the circumstances, including the child’s rights and responsibilities.

In the UAE, once a marriage is legally registered, it creates full legal rights and obligations regardless of the personal reasons behind it. An agreement to divorce later is not legally binding unless both parties actually consent to divorce at the time of filing.

Current legal position:
- The marriage remains valid until a court grants a divorce.
- If the wife no longer agrees to divorce, the husband cannot force separation without legal grounds.
- The child’s rights (support, custody, lineage) are fully protected under UAE law.

What the husband can do:
- Attempt an amicable divorce through mutual consent.
- If no agreement is reached, file for divorce based on harm, incompatibility, or irretrievable breakdown (depending on the applicable law and court).
- Attend mandatory reconciliation/mediation sessions before the case proceeds.

Important considerations:
- He remains financially responsible for the child regardless of marital status.
- If the wife seeks maintenance, housing, or other support, the court will assess entitlement.
- A fiancé relationship has no legal standing while the marriage remains valid.

Timeline:
- Mutual divorce: typically quicker (1–2 months).
- Contested divorce: may take several months depending on disputes.

Because family, financial, and custody rights are involved, careful legal handling is important.
