We got married in India in 2005. Now we are not together for 4 years. My husband is living in India and I live in UAE. He doesn't want to come here and I cannot leave my job in UAE to go and settle down in India. So how i can apply for Khulaa in UAE?

If you are living in the UAE and your husband is in India and unwilling to divorce, you may still seek Khula (wife-initiated divorce) through the UAE Personal Status Court, provided the court has jurisdiction over your case.


When UAE courts may accept jurisdiction




  • You reside in the UAE.




  • The marriage is legally documented.




  • The husband is absent or refuses to cooperate.




What Khula means
Khula allows a wife to end the marriage without the husband’s consent by returning the mahr (dowry) or agreeing to financial settlement terms set by the court.


Steps to apply




  1. File a family guidance application at the Personal Status Court.




  2. Submit required documents:




    • marriage certificate (attested & translated into Arabic)




    • passport and Emirates ID copy




    • proof of UAE residence






  3. The court will notify the husband in India.




  4. If reconciliation fails, the case proceeds to court.




  5. The judge may grant Khula upon settlement of financial terms.




If the husband does not appear
The court may proceed after proper notification and may issue a judgment in absentia.
