CASE Highlights My wife (44 years) and I (58 years) are from India, Hindu family staying in Abudhabi, UAE. My wife and I were married in Aug 22 (Second marriage for both) in Abudhabi Civil court. I want to file a No Fault Divorce, but my wife is opposing it and threatening to file a criminal case for adultery. She does not have evidence. But there were WhatsApp messages in my phone, which I already deleted. The record of staying together in Abudhabi hotels exists. But not in her knowledge. Though we never had any physical relations. My questions: Can I still file No Fault Divorce? What if she does not attend the hearing? Can I file the case and go to India and attend from there? What are grounds on which my wife can object to the divorce? Is it possible to file the case from India in Abudhabi court even after I leave UAE permanently? What can happen if she files criminal case here? Is staying in hotel with someone can be treated as adultery? Can divorce case continue irrespective of criminal case or it will be halted till criminal case is finalized?
