Assistance Request Regarding Property Guarantee Issue in Algoz, Algarve

Dear Sir or Madam,

I am writing to enquire about an ongoing issue with a brand-new property I purchased in Algoz, Algarve, in 2023.

According to Portuguese law, new properties come with a legal guarantee, and the builder is responsible for repairing or replacing any defects or nonconformities within 90 days of notification.

Since purchasing the property, I have repeatedly contacted the sellers by email and WhatsApp to have the issues rectified. However, despite my numerous attempts over the past three years, no action has been taken to resolve the problems.

Due to the seller’s inaction, I hired a solicitor to handle the matter on my behalf. Unfortunately, after two years, despite paying a substantial amount in legal fees, the solicitor has done very little and appears to be more sympathetic to the seller’s position. In fact, the amount I have paid in legal fees would have been enough to fix the property issues myself.

I am therefore requesting your guidance and assistance regarding this matter and to understand how I can enforce my property guarantee rights under Portuguese law.
