Proposal for Legal Services: Review of Prenuptial Agreement
Dear Client,
I am pleased to submit this proposal for the provision of legal services related to the review of a prenuptial agreement drafted in accordance with the laws of the State of Virginia, United States of America. As a Brazilian attorney with extensive experience in private international law, family law, and cross-border matrimonial agreements, I will ensure the document is properly reviewed, adapted where necessary for Brazilian recognition, and prepared for secure execution in Brazil.
Scope of Services
These services will include:
- Comprehensive review of the prenuptial agreement to assess its compliance with Virginia law, while considering Brazilian legal principles (e.g., Brazilian Civil Code provisions on regime de bens, pacta antenupciais, and requirements for recognition/enforceability in Brazil).
- Advice and recommendations on the terms, potential risks, and any suggested adjustments to better protect the interests of the Brazilian fiancée.
- Preparation of a bilingual version (English and Portuguese) of the agreement to facilitate full understanding and compliance with Brazilian formalities.
- Guidance on the notarization and authentication process.
- Full advisory assistance before a Brazilian notary public during the reading and signing of the agreement, ensuring that the document is properly explained, read aloud if required, and executed in accordance with Brazilian notarial rules (including presence of witnesses when applicable and compliance with Lei 8.935/1994 and Provimento CNJ).
These services do not include drafting the original prenuptial agreement from scratch or representing any party in court proceedings (judicial or extrajudicial litigation), but focus on review, advisory, bilingual preparation, and support for proper execution in Brazil. The work will be conducted remotely or in-person at my offices in Rio de Janeiro or São Paulo, as convenient for the parties.
Fees
In accordance with the Tabela Indicativa de Honorários Advocatícios 2025 of the Ordem dos Advogados do Brasil – Seção Rio de Janeiro (OAB/RJ), the minimum indicative fee for a legal opinion (parecer jurídico) combined with advisory services on family law contracts (including review and guidance on prenuptial agreements and extrajudicial acts) is R$ 5.000,00 (five thousand Brazilian Reais). This fee covers the full scope described above.
Payment terms:
- 50% upon acceptance of this proposal and commencement of work.
- 50% upon delivery of the legal opinion, bilingual reviewed document, and completion of notary advisory (if signing occurs within the scope).
Additional costs (e.g., certified sworn translation by a public translator, notary fees, authentication/apostille if required for Virginia law aspects, or travel expenses beyond Rio de Janeiro/São Paulo) are not included and will be quoted and reimbursed separately.
