Common questions

Must I use a lawyer to apply?

Under Rule 4, a person propounding a will or a proposed administrator may apply personally or through an attorney-at-law. [1]

What if several years have passed since the death?

Rule 9 requires the reason for delay to be certified to the Registrar when probate or administration is first sought after three years from the death. If the certificate is unsatisfactory, the Registrar must require such proof of the alleged cause of delay as they see fit. Rule 9 provides a late-application procedure rather than an automatic three-year cut-off. [1]

What should I do if a warning is served against my caveat?

A caveator with an interest contrary to the person warning may enter an appearance in the Registry and serve a sealed copy on that person within eight days of service, excluding the service date, or later if no Rule 42(3) affidavit has been filed. A caveator without a contrary interest who opposes a grant to that person may issue and serve a summons for directions before a judge. After non-response, filing the Rule 42(3) affidavit showing due service and no receipt of a summons for directions ends the caveat. [1]

Can an executor living abroad arrange a local application?

Yes. Rule 29 permits a grant to a duly appointed attorney where an executor or administrator is outside the court's jurisdiction. The power of attorney must be duly recorded. [1]

Can a child seek support despite the terms of a will?

For deaths after 13 November 1975, section 100 covers a minor child or a child unable to maintain themselves because of mental or physical disability. The court must find a failure to make proper provision according to the deceased's means. Apply within 12 months of the first grant; the court has treated this as a strict limit. An order cannot reduce a surviving spouse's legal right or, where that spouse is the child's parent, their benefit under the will or intestacy. [4]
