Question

Can the rest of the children proceed with the SPA assignment to 1 of the siblings even if 1 of the children doesn't want to sign the SPA intended to process the proceeds from the bank accounts which are about to be dormant and transfer the land titles? if not, what are the other legal remedies?

Yes, you can proceed with the assignment of an SPA to one of the siblings; however, the law provides that all heirs must conform with executing certain estate settlements, and if proceeded without the consent of all of the heirs, they may file an action nullifying such settlement.
