I doubt my lawyer failed to file a Certiorari after the CA denied my appeal. He did not visit or informed me at my detention if he indeed file.
Date of detention May 8, 2024
I am very hopeful to get a good favor from the SC on the basis.
RTC base its findings on 2 witnesses testimony and is not supported by an autopsy.
CA admitted in its decision that on cases of murder or homicide an autopsy is an advantage but in the absence the testimony of the 2 witnesses is already sufficient.
The attending physician did not provide an x-ray or performed an autopsy to determine the ribcage damage but he base his understanding from the history fed by the immediate family. He based his findings by touch. He did not see any hematoma on any parts of the body of the victim.
We doubted the victim died of heart attack when he was transported 24 kms to the hospital as DOA.

Criminal conviction requires more than the 'history fed by the immediate family' of the victim, but proof beyond reasonable doubt. I can see based on your narration that this quantum of evidence was not met during the trial of your case in the lower courts. If you were deprived of your day in court to prove your innocence by the insufficiency of the evidence of the prosecution, there should be legal remedies to elevate your case to the higher court, of which I am willing to help.
