Please i need your legal advice
Some of my tenants were severed notice to quit one month and later seven days because they are owing and our tenancy agreement says so. but they don't want to give up possession, and I don't want this lengthy court process
All i want to know is if i still have the right to increase their rent since they don't want to pack out

serving a notice to quit means the tenancy has been terminated; all that is left is for possession to be recovered. Legally speaking, you cannot increase the rent of a tenant whose tenancy you have terminated; the right process would be going through the court route or collecting Mesne Profit on the old rate.

a few legal ways to tackle the issue of the tenants not delivering possession would be:
- Negotiate with them on a peaceful move-out date
- issue a final notice to quit (with the time negotiated), preferable served by the court bailiff to show your seriousness.
- involve a lawyer. even if you do not want to go to court, allowing a lawyer deal with the tenants passes across the message of seriousness.
