All three lawyers—representing the parents and, where applicable, the child's guardian ad litem—will discuss the key issues, explore possible settlement options, and try to narrow the points of disagreement. If the parties reach an agreement during that meeting, the terms are usually recorded in a consent order (or a written settlement agreement) which is then filed with the Family Court and becomes legally binding. If no agreement is reached, the case will move forward to a contested hearing, where the court will set a timetable for further evidence, possibly order additional mediation, and eventually make a determination on custody (care and contact) based on the child's best interests.
