Can I enforce a mediation settlement in the Isle of Man if the other side refuses to pay?

We reached a written settlement at mediation, signed by both of us, but they’ve now missed the payment date and stopped replying. I want to know what steps I can take to make it binding or enforceable here, and how long that might take.

Thank you for your message. In the Isle of Man, a written settlement reached at mediation and signed by both parties may be contractually binding, but it is not automatically enforceable like a court order. If the other party has failed to comply with the agreed payment terms, the usual next step is to apply to have the settlement formalised, either by asking the court to approve it as a consent order (if proceedings are ongoing) or by issuing enforcement proceedings based on breach of the settlement agreement. The timeframe depends on whether court proceedings are already in place and whether the other party engages once formal steps are taken. In many cases, sending a formal letter before action or filing an application with the court prompts compliance relatively quickly, but if enforcement is contested, the process can take several weeks or longer. I recommend gathering the signed settlement agreement and proof of non-payment and seeking advice on the most efficient route to convert the agreement into an enforceable court order. Sincerely, Ascendance International Consulting
