Under what clauses of annulment should I file to my ex husband who is a bisexual?

Hello. I was married with my ex husband last 2023 - civil wedding. We only live under the same roof for at least 2 months and after that things went rough. He is bisexual with past relationship of 7 years same sex live in before me. I accepted him for who he is but suddenly after marriage, he changed. He never supported me financially from the start. He's capable but he is not maturely prepared. I've suffered so much because of him but I did not do any consultation with psych because I only pray harder everyday. Now it's been almost 3 years since we got separated, he blocked me and my family. So I have no contact of him at all. Is there any chance that I could file an annulment now even if I dont have proper communication with him? And how long would it take to process? Should I file it under what circumstances in law? Thanks!

Hello, and thank you for reaching out. I’m sorry to hear about the struggles you've been through. In regards to your question, yes, you may still file for an annulment even if you don’t have direct contact with your ex-husband. In cases where one party is unreachable, the court can still proceed with the annulment based on legal provisions, especially if you can prove grounds such as psychological incapacity or lack of support, which are common in annulment cases.

The specific grounds for annulment vary, but in your situation, psychological incapacity (which refers to an inability to perform marital obligations) could be a relevant reason. If you were never fully supported financially, and there were significant emotional and psychological challenges in the marriage, this might be considered. It's advisable to consult with a family lawyer to evaluate your case in detail, as they can help you gather the necessary evidence and determine the best approach.

As for the timeline, annulments in the Philippines can take anywhere from 1 to 3 years, depending on the court's schedule and how complex the case is. Some cases may take longer if there are challenges in locating the other party, but the court will find ways to serve him through legal means. Let me know if you need further help!

Sincerely,
