Was this sexual assault if I said no while intoxicated but he continued?

I was heavily intoxicated at a male friend’s apartment when he undressed me and initiated sex. I verbally said no and told him I did not feel okay, but he continued anyway.

During the act he asked if he should stop. I was drunk, confused, and already in the situation and said “later,” which was not a clear or voluntary consent. He continued until he finished.

He also recorded a video without my prior agreement. I only found out about the video the next day and he told me that it was me who asked to take a video even though I know myself I don’t want it and as far as I remember when he was saying something to me and I think he said something about recording and I told him to use my phone instead.

I am now safe and no longer in contact with him. I want to know if this legally qualifies as sexual assault or rape, and what my legal options are.

Yes, the conduct you described meets the legal definition of rape/sexual assault in virtually every jurisdiction because you were heavily intoxicated, clearly said “no,” and the man continued after you withdrew consent, and he also made an unauthorized recording—a separate crime in most countries; you should immediately report the incident to the police (request a forensic medical exam and preservation of the video), seek a protective or restraining order, and contact a victim‑support service for counseling, and although you can file the criminal complaint yourself, you’ll likely need a lawyer if you later pursue a civil damages claim for emotional and economic harm or if the case proceeds to trial.
