In PNG, can I enforce a mediation settlement if the other side refuses to pay later?

I signed a mediation agreement over an unpaid invoice and both parties agreed on a payment date. Now they are ignoring my messages and say the agreement is not "court". What steps can I take to enforce it in Papua New Guinea?

In Papua New Guinea a mediation settlement is treated as a binding contract (often called a 'deed of settlement') even though it is not a court order, so you can enforce it by bringing a breach-of-contract action in the appropriate court. First, send the other party a formal demand letter (preferably by registered post) reminding them of the payment date, attaching a copy of the signed mediation agreement and stating that, unless the amount is paid within a reasonable period (e.g., 7–10 days), you will file a summons in the Magistrates’ Court (if the claim is below the monetary limit for that court) or the Supreme Court (for larger sums). In the pleading you can ask the court to (a) declare the agreement enforceable, (b) order specific performance (i.e., payment on the agreed date) or payment of the debt with interest under the Civil Procedure Act 1999, and (c) award costs. Once a judgment is obtained, you may obtain a Writ of Execution to seize assets or garnish bank accounts to satisfy the debt. If the other side disputes the validity of the mediation document, you can also file a motion to register the agreement as a deed under the Registration of Deeds Act 1975, which gives it the same evidential weight as a court order.
