Under Serbian law, the landlord cannot simply remove a tenant or terminate a commercial lease because another person offered a higher rent, especially if the lease is concluded for a fixed term. A properly executed lease agreement binds both parties, and the landlord may terminate it early only on the grounds prescribed by the contract or by law, such as non-payment, unlawful use, or another material breach.

However, the proper legal strategy depends on several factors, including:

  • the type of lease (fixed-term or open-ended),
  • termination clauses,
  • ownership of improvements,
  • your compliance with the contract,
  • and whether any notice was issued by the landlord.

Because these details can change the outcome significantly, we cannot provide a precise legal opinion without reviewing the lease agreement and understanding the specific circumstances.
