An English man lived with his Swedish wife together in Schweiz for over 10 years, thus activating the little know exception rule in case law and pre-works of the law. This together with a hefty utterance regarding other connections to Sweden, besides from his wife and a need for the citizenship, made this individual a Swedish citizen without even having a permit to live here.

The couple had a child under the process, thus activating FEUF and the right of the child to enjoy the freedom om family under EU stature, giving the father as residence permit.

This last months AdamLaw has received several approved applications for Right of Residence Card (Uppehållskort) with 5 years validity for family members to EU-citizens. Nothing unusual about that until we add the fact that the "EU-citizens" are Swedish citizens and the applications made to the Swedish Migration Agency to legalize residency in Sweden.
For all you who have heard about the ruling C-370/90, also known as "Surinder Singh", this in not unheard of at all. An EU-citizen who activates his rights to freedom of movement, living at least three months in another EU-country an resettles is his home EU-country has the right to bring a third country national family member back as a family member to an EU-Citizen, thus not having to go through the national migration laws much longer and much more investigatory application process for a residence permit.
The case we present here is worth mentioning because the client was unaware of the possibility and was seeking legal guidance for an upcoming application for residence permit through the national rules, with its extensive processing times and issues regarding living apart for the process due to being unable to apply from within Sweden.
During the consultation the clients travel history opened up to advice the "Surinder Singh Route" instead. All said and done, we assisted the client down this path and without the happy couple being forced apart (You are allowed to stay during the application process), a couple of weeks later the family member now has the legal right to stay in Sweden for 5 years and will become permanent automatically! AdamLaw got appointed public consul recently in a revocation case. Our klient had refugeestatus and residence permit in Sweden. When applying for permanent residence permit in Sweden, the Swedidh Migration Agnecy launched an investigaton into the clients travel history and found three seperate travels to the very country against which the protection status was originally issued.
For the Agency, this equals to the lack of direct treath against the individual and potentially allegation regarsing giving them false information. This in turn means grounds to revoke a protection status and deportation from Sweden.
As public consul for this client, we showed to the Swedish Migration Agancy that;
1. The threat is not automaticlly lesser or nonexisting just becouse an individuall under such treath managed to avoid it during a visit.
2. The asulymgrounds are still valid, the threat of protected actions still as likely as before and the fear of its realization as grave as it ever was. I would say we even managed to show its progression.
3. The clients rooting in the Swedish society and establishment on the Swedish work force is strong enough to warrant a PR.
The decision (not verdict, becouse it stayed at Migration Agency level) resulted in kept protection status (even if reduced from refugee to the subsidary protection status) and an approved permanent residence permit.
Success in an asylum revocstion case joined with a potential PR is one of the most important and priviliged cases we can think of to win. And it came in december as a great end of 2025!
