If the parties reach an agreement during that meeting, the terms are usually recorded in a consent order (or a written settlement agreement) which is then filed with the Family Court and becomes legally binding. If no agreement is reached, the case will move forward to a contested hearing, where the court will set a timetable for further evidence, possibly order additional mediation, and eventually make a determination on custody (care and contact) based on the child's best interests.
