Can I get a divorce based on 3yrs abandonment?

Hello, I'm 39yrs old and based in Oshogbo Osun State I got married to my husband in July 2014, and he left home in Jan 2021, on ground he wanted to look for a Job, but he is based in Lagos now and refused to visit me the 3kids despite all the pleading and family intervention. I'm ready to move on, as I don't love him anymore.

Dear, I'm sorry to hear that you're going through such a challenging situation. If you have decided to move on and are considering legal steps, here are some general suggestions: Consult with a Family Lawyer: Seek the advice of a family lawyer who can guide you through the legal aspects of separation and divorce in Nigeria. They can provide specific information based on the laws in Osun State. Legal Grounds for Divorce: Nigeria recognizes various grounds for divorce, including desertion, which seems to be applicable in your case. Discuss the specific circumstances with your lawyer to determine the most suitable grounds for your situation. Documentation: Gather relevant documents such as your marriage certificate, evidence of his departure, and any communication regarding his refusal to visit or support the family. Mediation: Mediation is often encouraged to resolve disputes amicably. Your lawyer may advise attempting mediation before proceeding with legal actions. Child Custody and Support: If you have children, discuss with your lawyer about child custody arrangements and child support. The welfare and interests of the children are typically a priority in divorce proceedings. Property and Asset Division: Consult with your lawyer regarding the division of marital property and assets. Nigerian law considers factors like contributions to the marriage and needs of both parties. Legal Proceedings: If an amicable resolution is not possible, your lawyer can guide you through the legal process of filing for divorce. This involves filing a petition, court appearances, and the finalization of the divorce decree. Emotional Support: Going through a divorce can be emotionally challenging. Seek support from friends, family, or a counselor to help you cope with the emotional aspects of this process. Remember that legal processes can vary, and it's crucial to consult with a lawyer familiar with the specific laws in Osun State. They can provide advice tailored to your situation and ensure that your rights and interests are protected throughout the divorce proceedings. You may want to verify the current contact details for the Nigerian Bar Association or other legal resources in Osun State. If you need our assistance to put you through a lawyer there, please let us contact us and send us a direct message
