Can a lessor terminate our contract of lease because he changed his mind?
Landlord & Tenant
Good day from Recososa Law Firm!Based on your account, the unilateral termination of the lease by the lessor despite a binding agreement until 2035 is not legally justified under Philippine law. Even if the contract does not mention the underlying debt, the lease agreement itself is a valid and enforceable contract under Article 1305 of the Civil Code, which defines a contract as a meeting of minds between two persons whereby one binds himself to give something or to render some service.a.) Under Article 1306 of the Civil Code, parties may establish such stipulations as they may deem convenient, provided they are not contrary to law, morals, good customs, public order, or public policy. Since the lease contract clearly states a fixed term and rental rate, the lessor cannot simply revoke it at will due to a change of mind. Any attempt to do so may constitute breach of contract.b.) Even if the lease served to compensate for the unpaid debt, the contract remains valid and binding unless it is shown that consent was vitiated by fraud or mistake. Your rights as a lessee are further protected by Article 1673 of the Civil Code, which limits the grounds for judicial ejectment. None of those grounds include the lessor’s change of intent.c.) In your case, you may file an action for specific performance with damages or an injunction to restrain the lessor from unlawfully evicting you. Since the lease is for a definite period, you have the right to enjoy peaceful possession of the property until 2035. The law on contracts upholds the principle of mutuality, meaning one party cannot revoke the obligation without valid cause.d.) If the lessor forcibly takes steps to evict you, you may also consider filing an action for injunction or even unlawful detainer if possession is disturbed, and you may claim for actual damages and attorney’s fees under Article 2201 of the Civil Code.We strongly advise that you hire us so we can carefully examine your lease contract and file the necessary legal remedies to protect your tenancy rights and enforce the long-term lease agreement. About Landlord & Tenant Law in Quezon City, Philippines:

Landlord and Tenant Law in Quezon City, Philippines governs the legal relationship between landlords (the property owners) and tenants (those who rent or lease the property). It lays out the rights and responsibilities of both parties to ensure fair and harmonious transactions. Understanding these laws is crucial for tenants and landlords alike to protect their interests and maintain a healthy landlord-tenant relationship.

Why You May Need a Lawyer:

While renting a property in Quezon City, there are various situations where seeking legal advice from a lawyer specializing in Landlord and Tenant Law may be necessary. Some common scenarios include:

  • Eviction disputes
  • Lease agreement violations
  • Property maintenance and repair issues
  • Security deposit disputes
  • Rent increase conflicts

Having a lawyer can help protect your rights, mediate disputes, negotiate fair terms, and ensure legal compliance throughout the landlord-tenant relationship.

Local Laws Overview:

In Quezon City, Philippines, the following key aspects of local laws are particularly relevant to Landlord and Tenant:

  • Republic Act No. 9653 or the "Rent Control Act of 2009" sets limits on rent increases, eviction conditions, and provides security of tenure for tenants.
  • The Civil Code of the Philippines addresses various aspects of landlord-tenant contracts, including rights and obligations, lease terms, and eviction procedures.
  • The Quezon City Housing Code establishes regulations for the maintenance and safety of rental properties, ensuring habitability standards for tenants.

Frequently Asked Questions:

1. Can a landlord increase the rent anytime they want?

No, landlords are subject to rent control under the "Rent Control Act of 2009." They can only increase the rent when the lease agreement ends or once every three years, as long as proper notice is given.

2. What can I do if my landlord refuses to make necessary repairs?

If your landlord fails to address repair issues that affect habitability or violate safety standards, you can file a complaint with the appropriate government agency or seek legal advice for proper recourse.

3. How long does the eviction process take in Quezon City?

The length of the eviction process can vary depending on the circumstances and legal proceedings involved. It typically takes several months and involves notifying the tenant, filing a case in court, and obtaining a court order for eviction.

4. Can a landlord withhold my security deposit without valid reasons?

No, a landlord can only withhold a tenant's security deposit for unpaid rent, damages beyond normal wear and tear, or any other agreement specified in the lease contract. If you believe your security deposit was unjustly withheld, you can seek legal advice to resolve the matter.

5. What are the rights of tenants under Quezon City's Housing Code?

Under the Quezon City Housing Code, tenants have the right to reside in a well-maintained, safe, and habitable dwelling. Landlords are responsible for ensuring property maintenance, providing necessary utilities, and keeping the premises clean. Tenants can report violations to relevant government agencies for proper action.
