Can we evict tenants of our property if it is sold?
Landlord & Tenant
Hello:Under Philippine law, the rights of both the property owner and the tenants are governed mainly by the Civil Code and the Rent Control Act (if applicable depending on the rental amount). Since you mentioned that the tenants are not paying rent or deposit, they are already in breach of their lease contract. In such case, you have legal grounds to demand their eviction.a.) Non payment of rent is one of the valid causes to eject a tenant under Article 1673 of the Civil Code. The law recognizes the owner’s right to repossess the property once the lessee fails to comply with his obligation. b.) Even if you sold the property, the new owner generally respects the lease if it is valid and binding. However, because in your situation there is no payment of rent, you or the buyer can institute an ejectment case (unlawful detainer) before the Municipal Trial Court to legally remove them.c.) Since you already gave them notice but they still refuse to vacate, the remedy is to file an ejectment case in court. Self help or forcibly evicting them without a court order is not advisable as it may expose you to counterclaims. We at Recososa Law Firm handle these kinds of cases regularly. We can assist you in preparing the demand letter, filing the unlawful detainer case, and representing you until you legally recover possession of your property. About Landlord & Tenant Law in Saxonwold, South Africa

Landlord and tenant law in Saxonwold, South Africa, falls under the general body of South African property law, which governs the renting or leasing of property. It outlines the rights and responsibilities of both landlords and tenants and aims to ensure fair and equitable treatment of both parties in rental agreements. These laws cover issues such as lease agreements, rent control, deposit handling, maintenance duties, and tenant protection against unfair eviction practices.

Why You May Need a Lawyer

There are various situations where one might require legal advice or assistance in landlord and tenant matters. These include:

  • Lease Agreement Disputes: When there is a disagreement over the terms or execution of a lease agreement.
  • Eviction Processes: If a landlord is seeking to remove a tenant legally or a tenant is facing an eviction notice.
  • Unresolved Maintenance Issues: Legal intervention might be required if a landlord fails to address essential repairs, making the property uninhabitable.
  • Unfair Rental Practices: Assistance may be needed if a tenant believes they are subject to unfair rent increases or discrimination.
  • Deposit Disputes: Issues surrounding the return or deductions from a security deposit.

Local Laws Overview

Saxonwold, being a suburb of Johannesburg, adheres to local and national regulations set by the South African government regarding landlord and tenant matters. Key aspects of these regulations include:

  • The Rental Housing Act: The Act provides a basic framework ensuring that the rights of both landlords and tenants are protected, detailing landlord obligations and tenant rights.
  • Consumer Protection Act: Offers tenants protection against unfair practices and stipulates that lease agreements must be clear and understandable.
  • Evictions Act: The Prevention of Illegal Eviction from and Unlawful Occupation of Land Act outlines the correct procedure for evictions to ensure they are carried out fairly.
  • Lease Agreements: Must be written, outlining all terms and conditions, signed by both parties, specifying rental amount, duration, and other critical details.

Frequently Asked Questions

What should be included in a lease agreement?

A lease agreement in Saxonwold must include details of the property, rental amounts, deposit requirements, lease duration, renewal terms, maintenance responsibilities, and any other agreed-upon terms between the landlord and tenant.

Can a landlord increase rent anytime?

Landlords can only increase rent as stipulated in the lease agreement, usually after the lease term ends. Tenants must be given adequate notice as per the rental agreement or, generally, one to two months if unspecified.

How much deposit can a landlord ask for?

While no legislation caps the deposit in South Africa, it is standard practice to request a deposit equivalent to one or two months’ rent, detailed within the lease agreement.

What are my rights concerning repairs?

As a tenant, you have the right to a habitable living environment. Landlords are typically responsible for essential repairs and maintenance. Requests should be made in writing, and legal action can be sought if repairs are not addressed timely.

How can I recover my deposit after the lease ends?

The deposit should be returned within seven days of the lease's conclusion, provided there are no damages or arrears. Any deductions must be itemized and justified by the landlord.

What can I do if I receive an eviction notice?

If you receive an eviction notice, review the legality and process in the notice. Seek legal advice if you believe the eviction is unfounded. The eviction can only proceed with a court order.

How are disputes over utilities resolved?

Disputes should be addressed by reviewing the lease terms regarding utility payments. Often, legal intervention helps resolve outstanding issues if they persist post-discussion.

Can a landlord enter the property without notice?

Landlords have no right to enter a rental property without the tenant’s consent, except in emergencies. Entry should be agreed upon beforehand and at a reasonable time.

What is the process for early lease termination?

Early termination must comply with lease terms. A mutual agreement with potential financial penalties or notice requirements might be stipulated in the contract.

Are verbal lease agreements enforceable?

While verbal agreements may be recognized, they are harder to enforce than written contracts. It’s advisable to have a written agreement to avoid ambiguity and legal issues.
