Can we evict tenants of our property if it is sold?
Landlord & Tenant
Hello:Under Philippine law, the rights of both the property owner and the tenants are governed mainly by the Civil Code and the Rent Control Act (if applicable depending on the rental amount). Since you mentioned that the tenants are not paying rent or deposit, they are already in breach of their lease contract. In such case, you have legal grounds to demand their eviction.a.) Non payment of rent is one of the valid causes to eject a tenant under Article 1673 of the Civil Code. The law recognizes the owner’s right to repossess the property once the lessee fails to comply with his obligation. b.) Even if you sold the property, the new owner generally respects the lease if it is valid and binding. However, because in your situation there is no payment of rent, you or the buyer can institute an ejectment case (unlawful detainer) before the Municipal Trial Court to legally remove them.c.) Since you already gave them notice but they still refuse to vacate, the remedy is to file an ejectment case in court. Self help or forcibly evicting them without a court order is not advisable as it may expose you to counterclaims. We at Recososa Law Firm handle these kinds of cases regularly. We can assist you in preparing the demand letter, filing the unlawful detainer case, and representing you until you legally recover possession of your property. Local Laws Overview

In Scottburgh, several key aspects of landlord and tenant laws are noteworthy:

  • Lease Agreements: Must comply with the Rental Housing Act, outlining terms clearly in writing.
  • Tenant Rights: Tenants have the right to privacy, fair treatment, and a habitable living environment.
  • Evictions: The Prevention of Illegal Eviction Act requires due process, ensuring tenants are not evicted unlawfully.

Frequently Asked Questions

What should be included in a lease agreement?

Lease agreements should include rent amount, payment terms, deposit details, lease duration, and termination conditions, among other specifics such as maintenance responsibilities and tenant rights.

Can a landlord evict a tenant without notice?

No, evictions must comply with legal requirements. The landlord must obtain a court order and follow due process as outlined in The Prevention of Illegal Eviction Act.

What can a tenant do if a landlord does not perform necessary repairs?

Tenants can first notify the landlord in writing. If unresolved, they can approach the Rental Housing Tribunal or seek legal advice to enforce the lease terms or seek remedies.

How often can a landlord increase rent?

Rent can typically be increased annually, unless otherwise specified in the lease agreement, with the increase being subject to reasonable standards or CPI guidelines.

Is a verbal lease agreement valid?

While verbal agreements are legally binding, they can be challenging to enforce. It is advisable to have written agreements to avoid disputes.

What is a Rental Housing Tribunal?

The Tribunal is a platform for landlords and tenants to resolve disputes without incurring legal costs. It offers mediation services and adjudication when necessary.

Are deposits refundable?

Yes, provided there are no damages or arrears. Deposits should be refunded with interest within the stipulated time after the lease ends, as required by law.

Can a tenant refuse entry to a landlord?

Tenants have the right to privacy. Landlords need to provide reasonable notice and have legitimate reasons (like repairs) for entering the property.

What happens if a tenant defaults on rent?

Landlords can issue a notice to remedy the breach. If unresolved, they may proceed with legal actions which could include eviction proceedings following appropriate legal protocols.

Who is responsible for utility payments?

Responsibilities for utility payments should be outlined in the lease agreement. Typically, tenants pay for consumables like water and electricity, although different arrangements can be agreed upon.
