Can we evict tenants of our property if it is sold?
Landlord & Tenant
Hello:Under Philippine law, the rights of both the property owner and the tenants are governed mainly by the Civil Code and the Rent Control Act (if applicable depending on the rental amount). Since you mentioned that the tenants are not paying rent or deposit, they are already in breach of their lease contract. In such case, you have legal grounds to demand their eviction.a.) Non payment of rent is one of the valid causes to eject a tenant under Article 1673 of the Civil Code. The law recognizes the owner’s right to repossess the property once the lessee fails to comply with his obligation. b.) Even if you sold the property, the new owner generally respects the lease if it is valid and binding. However, because in your situation there is no payment of rent, you or the buyer can institute an ejectment case (unlawful detainer) before the Municipal Trial Court to legally remove them.c.) Since you already gave them notice but they still refuse to vacate, the remedy is to file an ejectment case in court. Self help or forcibly evicting them without a court order is not advisable as it may expose you to counterclaims. We at Recososa Law Firm handle these kinds of cases regularly. We can assist you in preparing the demand letter, filing the unlawful detainer case, and representing you until you legally recover possession of your property. About Landlord & Tenant Law in Swellendam, South Africa

Landlord and tenant law in Swellendam, South Africa, is governed by both national and local regulations that ensure the rights and responsibilities of landlords and tenants are upheld. This framework is established primarily to maintain a fair and equitable rental market. Key legislation includes the Rental Housing Act and the regulations enforced by local municipal bylaws. This legal framework ensures issues such as lease agreements, rent control, eviction processes, and maintenance responsibilities are well-managed so disputes can be efficiently resolved.

Why You May Need a Lawyer

Several situations can arise where legal assistance may be beneficial for landlords and tenants. Common scenarios include disputes over rental agreements, non-payment of rent, property maintenance disagreements, unfair evictions, and breaches of lease terms. Landlords may need assistance with drafting legally binding contracts and understanding eviction procedures, while tenants may require help lodging complaints about unfair practices or negotiating lease terms. Legal professionals can provide guidance to ensure that rights are upheld and conflicts are resolved according to legal standards.

Local Laws Overview

In Swellendam, like the rest of South Africa, the Rental Housing Act serves as a pivotal piece of legislation. It outlines the responsibilities of landlords and tenants, stipulates the rights to live in habitable environments, and sets standards for lease agreements. Locally, Swellendam's municipal bylaws may impose additional requirements, particularly regarding property zoning, maintenance standards, and property taxes. It is essential for both landlords and tenants to be familiar with their rights and responsibilities under these laws to prevent disputes.

Frequently Asked Questions

What should I include in a rental agreement?

A rental agreement should include details such as the rental amount, payment terms, duration of the lease, tenant and landlord obligations, maintenance responsibilities, and procedures for ending the lease.

How is rent determined in Swellendam?

Rent is typically determined by market conditions, property location, size, and amenities. However, any excessive rent demands can be challenged through the Rental Housing Tribunal.

What are my rights as a tenant regarding maintenance?

Tenants have the right to live in a property that is well-maintained and safe. Landlords are generally responsible for major repairs and maintenance, while routine upkeep may fall to the tenant as specified in the lease.

What is the legal process for eviction?

Eviction must follow legal procedures that involve providing adequate notice to the tenant and obtaining a court order if the tenant fails to comply. Unlawful evictions are illegal and can result in legal penalties.

Can a landlord increase rent whenever they want?

No, rent increases typically occur once a year and must be stipulated in the lease agreement. Any increase must be fair and reasonable in relation to market norms.

What is my recourse if my landlord does not provide basic services?

Tenants can lodge complaints with the Rental Housing Tribunal if landlords fail to provide essential services outlined in the lease, such as water and electricity.

How can disputes be resolved without going to court?

Many disputes can be resolved through mediation facilitated by the Rental Housing Tribunal, which aims to settle issues amicably before considering legal action.

Are verbal lease agreements valid?

While verbal agreements can be valid, written agreements are strongly advised as they provide concrete evidence of the terms agreed upon by both parties, reducing the risk of disputes.

What happens if a tenant cannot pay rent?

Inability to pay rent can lead to eviction. However, communication with the landlord and exploring renegotiation or payment plans can sometimes provide temporary relief.

Is a deposit mandatory for renting a property?

While not legally mandatory, deposits are customary and serve as security for landlords against potential damages. The amount and conditions for refund should be clearly outlined in the lease agreement.

Additional Resources

For further assistance, individuals may contact the Rental Housing Tribunal for guidance on disputes. The Swellendam Municipality provides information regarding local housing regulations.
