Bankruptcy & Debt
We assist lenders, borrowers, company management and individual creditors in negotiations on business restructuring, debt restructuring and bankruptcy.
Our bankruptcy lawyers provide legal and strategic advice in, among other things, the following types of cases:
- Assessment of whether a business with financial challenges can and should be restructured according to the Restructuring Act. In general, the Restructuring Act provides good tools, which can help a company to get back on its feet financially - often by reducing the debt in combination with the deposit of new equity capital. The first step is to carry out an analysis of the company's financial status and how this can be improved through the tools in the law.
- We provide advice on all stages of the process and can assist in negotiations with banks, creditors, contractual partners and public authorities.
- If it is not appropriate to save the existing business through reconstruction, we can give advice and assist in connection with requests for tenders, assist the former management during the bankruptcy proceedings, and possibly assist with the purchase of assets from the estate.
Our bankruptcy lawyers are regularly assigned assignments as trustees at the Hordaland district court and have a number of bankrupt estates for processing on an ongoing basis, of which we have handled several of the largest bankruptcies in Western Norway over the years. Furthermore, we have assignments as reconstructors according to the Reconstruction Act.
Lawsuits & Disputes
Disputes between actors in business can arise in a number of different forms. For a good result, it is crucial to have sharp, commercially oriented assistance at all stages of the process.
Our lawyers have extensive experience with all forms of dispute resolution in a number of different legal areas. Dispute resolution does not only include processes before the courts, but just as often negotiations, both with and without external assistance. Our experience is that expensive and time-consuming legal processes can often be avoided if the parties' positions are investigated as early as possible and possible solutions are explored. If it is not possible to reach a negotiated solution, we assist in cases both before ordinary courts, in arbitration or with other forms of alternative dispute resolution. Our lawyers have experience with procedural assignments within a wide range of disputes, including:
- Contract and tort disputes, including defects in the delivery of goods and services, breach of contract and invalid agreements.
- Transport and maritime law disputes, including in connection with cargo damage, breakdowns and charter parties.
- Disputes within employment law, including dismissals, dismissals and working environment matters.
- Disputes relating to real estate, including real estate transactions, tenancies and neighboring rights.
- Corporate law disputes, including shareholder conflicts and board liability.
- Disputes within public procurement and competition law, including complaints and sanctions.
- Disputes relating to intellectual property rights, such as patents, trademarks and copyrights.
