Trademark

A trademark is considered any point capable of graphic representation, capable of distinguishing the products or services of one company from those of other companies. Trademarks  can be in particular: names of natural or legal persons, words, nicknames, company name, logo, illustrations, designs, letters, numbers, the shape of a product, the shape of a package, newspaper or magazine title. The registration of a trademark ( registration of a name , designation, registration of a logo, registration of a brand name) is an act of defending the interests of a company or business and not only that. The process is complex and requires experienced and delicate handling by a lawyertrademarks as a small change in the description of a service can prevent an objection process from large multinational companies. An experienced trademark attorney will safely guide you in protecting your trademark. Trademarks can be registered nationally, globally or across Europe.

The trademark (brand)  is undoubtedly capital for a business. Trademarks are the weapon that every business must have in order to become known and establish itself in the consciousness of the consumer public. Through the trademark, each consumer distinguishes a company, then recognizes it and finally chooses it. The brand is of particular importance because of the goodwill it encapsulates and offers to the business. In particular, a trademark embodies the guarantee of quality and good reputation for the marketed products or services provided by the company. The truth is that a brand is a company's most valuable intangible asset that requires ongoing legal protection, especially when it is associated in the consumer's mind with a fast-growing business that enjoys recognition and exhibits increasing business activity and a strong advertising presence. , because then it is a pole of attraction for possible bad faith copying by competitors.

The first piece of advice a trademark attorney should give anyone interested in starting a new business is to trademark the business. The registration of the trademark provides the owner with an exclusive right over the trademark as a result of which he can de facto prevent any possible competitor from the illegal use of the same or a similar trademark. Before the registration process can proceed, an experienced trademark attorney needs to perform a legal pre-check of the availability of the trademark, so that it can be ensured that no objection letter will be submitted by the Ministry of Trademarks regarding the registration of the trademark. signal.

Every company operates in a specific business sector and wants the products or services it produces/provides or markets to refer to it and stand out from the corresponding competing companies and not only that. Trademark registration or name registration is the process that helps to  distinguish products or services of two different businesses with different trademarks. This connection of the products/services of a company occurs in the eyes of the consumer public only with the trademark, whether it consists of a single word or a combination of characteristic elements (verbal part, illustration, color composition, number, packaging, etc.).

The power of a trademark is invaluable and the risk of not registering a trademark is great. There are not a few recent incidents of malicious trademark registration of Greek companies by third-party competitors, mainly in the PRC according to recent publications of the Panhellenic Association of Exporters. The legal protection of the trademark is therefore of immense importance and must be prioritized. It is therefore considered advisable to register a trademark before starting a business.

The lawyer for trademark registration (name registration) advises the following: in principle, it should be a trademark that has distinctive power , not be a copy of a possibly competing trademark in the same field of activity, be original, to be easily remembered and above all not to be descriptive. That is, accompanying words that can appear in a name, logo, brand name, distinctive title such as e.g. hotel, club, café, restaurant, etc. do not constitute trademarks, because they are common, i.e. they do not imply but precisely describe the activity of the business. It should therefore be preceded by a word, which has distinctive power and is original.

There are three levels of trademark protection and respectively we are talking about a national trademark , a Community trademark  ( European trademark registration ) or an international trademark  (worldwide trademark registration). If a company is active in the domestic market of Greece, the domestic registration of a national trademark covers it. Accordingly, if a natural person or company exports to Europe, the Community registration of a Community trade mark (European trade mark) is appropriate. Finally, if the exports are carried out to countries outside the European Union, the international registration of an international trademark worldwide is particularly important, but it presupposes that one or both of the previous registration procedures will have preceded it. Undoubtedly, when there is an online presence of a brand (e.g. e-shop), it is of primary importance to register a trade name due to the extensive exposure and it is by no means sufficient to register a website name (domain name).

Optionally, the presence of a company in a market with a distinguishing feature (name, brand, logo, mark, distinctive title), even if it is long-term, does not in any way protect the company from bad faith third parties, who may request and achieve the final and irrevocable registration of this mark, unless of course it is a reputation mark.

Real Estate

Property leases

In case of late payment of the due rents as well as non-payment of the due rents on the part of the tenant (lessee), the owner of the property can either terminate the lease with an action for termination-payment of rent or with an action for the return of the use of the lease due to delay in the rent from distress and payment of rent due. However, the fastest and most economical procedure is to serve the debtor tenant (tenant) with an extrajudicial order that will set a deadline for payment and then submit to the competent Magistrate's Court/Court of First Instance an application for the issuance of an order for the payment of rent and rent due

Every customer wants to choose a partner that optimizes the "triangle" of quality-speed-cost. Theoretically, a service cannot be both qualitative and fast and economical at the same time. Either it will be fast and quality but not cheap, or fast and cheap but not quality, or quality and cheap but not fast.

Since the establishment of our law firm, our primary and conscious goal has been the balance in the center of the quality-speed-cost triangle.
