A mother filed custody case where she wanted to dispense with the fathers consent. We vehemently defended our client - the father, and his right as a parent and his involvement in the childrens life despite having separeted from the mother. Our argument was hinged in Article 53 of the Constitution and section 31 and 32 of the Childrens Act. We argud that it was unlawful for the mother to deprive the children of their fathers love, identity and involvement. We urged the court to consider the best interest f the minors as spelled out inSection. 8 of the Children Act and the court agreed wit us.
The father's consent was not done away with.
