Our Law Firm manages/resolves/mediate any type of claim process for both Life Insurance, which includes classic life insurance and financial insurance, as well as Non-Life Insurance, which includes all insurance related to property as well as personal insurance (except life insurance).

The new insurances that are being created normally belong to the non-life business – they protect the property assets. Although the insurances can be segmented between private and business customers, this issue is not important, because an automobile liability insurance has the same possibilities (coverage and conditions) for any type of customer. There are specific insurances for each of the clients. – Personal Accidents – Travel Insurance – Work Accidents – Business Insurance, etc.

When there is a Road Accident and/or Work Accident and insurance policies are non-existent (for lack of a valid policy):

• In the case of Road Accidents it is necessary to report the accident to the Fundo de GarantiaAutomóvel which, as a result of road accidents occurring on the mainland or in the Autonomous Regions of Madeira and the Azores, originated from vehicles subject to compulsory insurance, registered in Portugal or in third countries to the European Union that do not have a National Insurance Office, or whose Office has not adhered to the Multilateral Agreement of Guarantees between National Insurance Services, up to the limit of the minimum capital of the compulsory motor liability insurance, the compensations that prove to be due for:
• Personal injury, when the person responsible is unknown or does not benefit from valid and effective insurance, or is declared insolvent by the insurance company;
• Material damages, when the person responsible, if known, does not benefit from valid and effective insurance;
• Material damages, when the person responsible, if unknown, must satisfy a compensation for significant bodily harm, or the causing vehicle, not benefiting from valid and effective insurance, has been abandoned at the scene of the accident and the police authority confirms its presence in the respective report. Within the Compensation Body, the Motor Guarantee Fund provides compensation to injured parties residing in Portugal, who have been victims in another Member State or in a country belonging to the “green card system”, of a road accident caused by a vehicle normally parked and insured in another Member State, other than that of their residence, or by an unknown vehicle or for which it has not been possible to identify the insurance company.
• In the case of Accidents at Work, the company (the entity responsible) is sentenced in the first line, but if this is not possible, the Fundo de Acidentes de Trabalho(FAT), which works with the Insurance and Pension Funds Supervision Authority and ensures it, may be called to account:
• a) the payment of the benefits that are due for an accident at work whenever, due to an objectively characterized economic incapacity in a bankruptcy lawsuit or equivalent process, or a company recovery process or due to absence, disappearance and impossibility of identification, they cannot be paid by the responsible entity;
• b) the payment of occupational accident insurance premiums of companies that, within the scope of a recovery process, are unable to do so, upon request submitted by the company’s manager;
• c) the payment of occupational accident pension updates and supplementary benefits payable by insurance companies;
• d) the placement of the refused risks of accidents at work in an insurance company.

Our Law Firm is at the service of individuals and companies who wish to collect debt and recover overdue and unpaid credits.

As a rule, the collection starts extra judicially, which presupposes, depending on each case, in a first stage to analyze the facts and the legal framework of the credit, later, and if necessary, locate the debtor and only then proceed to the interpellation of the same to fulfill the obligation, either through phone calls or through face-to-face meetings, we do the total monitoring of the negotiation, until the credit is totally liquidated.

In case of frustration of the extra judicial collection or when our team deems it a waste of time to do so, we resort to the mechanisms that the Law offers us for the collection of debts, the so-called judicial collection, which may be through:

. Injunction Request;

. Executive Proceedings (if there is already an executive title): which will allow us to make the attachment of wages, goods, bank deposits, cars, among others …., of the debtor;

. We require the Insolvency of Individuals or Legal Entities when all other legal mechanisms are no longer effective, so that our client’s credit is collected.
