Immigration
Any foreigner working in Thailand must obtain a Work Permit before beginning work. While a rospective employer may file an application on the foreigner's behalf in advance of his commencing work, the actual Work Permit will not be issued until the foreigner has entered Thailand in accordance with the mmigration laws and has presented himself to receive his Work Permit.
The Permit initially will be valid only for the period of the foreigner's Non-Immigrant Visa permits him to remain in Thailand under the Immigration Law. The Work Permit will be subject to renewal in accordance with the renewed or extended visa. For foreigners who are holders of a Thai Certificate of Residence, the Work Permit can be renewed annually. The Labor Department, subject to subsequent renewal, will in principle grant an initial duration of one year for the Work Permit. A Work Permit must be renewed before its expiry date or it will automatically lapse.
Intellectual Property
Thailand does not have any international agreements on trademark ownership. If your trademark is not registered in Thailand it is in danger of being claimed by another party. To regain control of your trademark after it has been registered by another person, is expensive and will take years, Even then you may lose your trademark in Thailand unless you register it before someone else.
If you as the true owner then wanted to challenge the ownership of the mark you may submit a petition to cancel the registration at the Intellectual Property Court in Bangkok .
This petition must be submitted within five years of the date that the previous registration of the mark in Thailand was approved, and the proof needed in order to cancel the registration is substantial .
The first step that an investor who owns the trademark should do, is protect their rights by registering the trademark at The Trademark Division of the Department of Intellectual Property (Ministry of Commerce).
In order to get the trademark registered it must:
• be distinctive
• not be the same as or similar to a trademark already registered by another person and
• not be otherwise prohibited by law.
Family
Marriage in Thailand is not a difficult process. As a foreigner, you are allowed to register your marriage to a Thai national or to another foreigner.
If you are married and your spouse does not agree to a divorce in Thailand then you will need to obtain a judgment from the Court. You need to use a lawyer for these steps. You cannot remarry until this has been annulled and you must be present in the Court in Thailand yourself. However, the lawyer will act as power of attorney on your behalf to do the preliminaries but you must appear at the final hearing in person. You are not permitted to have a power of attorney acting for you. Therefore "YOU MARRY IN THAILAND & Register in the local Marriage Office YOU MUST DIVORCE IN THAILAND".
We can assist you if living abroad. We will act as power of attorney and file to the Court on your behalf. You need to send us a copy of your passport, marriage certificate, Thai partner's ID copy, and as much information regarding your marriage, children, address of your last homes, and circumstances surrounding the breakup including dates and circumstances when the separation took place. This is important. Once we have a Court date you must appear before the Court for this final stage but we will still be acting for you.
