In Kuwait, there is no exact “class action” system like in the U.S., but Consumer Protection Law No. 67 of 2010 gives consumers the right to file complaints against sellers or manufacturers for defective or unsafe products.

Article 5 of the law: requires the manufacturer to ensure the product is safe and fit for use.

Article 7: grants the consumer the right to seek compensation if harmed by a defective product.

Article 12: defines the role of the Consumer Protection Department in receiving complaints and protecting consumer rights.

Consumers can coordinate their complaints through the Consumer Protection Department at the Ministry of Commerce and Industry (MOCI) or file civil lawsuits, which is similar in effect to a class action.

How to join an ongoing effort:

Identify the case

Monitor announcements from MOCI or news about collective complaints.

Some consumer rights organizations may coordinate these efforts.

Submit your complaint

You will need proof of purchase, details of the defect, and any correspondence with the seller or manufacturer.

This can be submitted directly to the Consumer Protection Department or through a lawyer if the case goes to court.

Deadlines

Under Kuwaiti civil law, a consumer can claim compensation for defective products within 3 years from discovering the defect.

If the collective complaint is organized by MOCI, they will announce specific deadlines for joining.
