Annulment

In Philippines

Last Updated: Aug 30, 2023

Hey! May I ask your good office about the annulment? I have been married for almost 8 years now and we have a son. But in the earlier yrs of our marriage, it looked as if I was not even married because he was not around, instead he chose to go back to their house and left us with my parents who helped me raise my kid until now(my son is with my parents as I'm currently working overseas.)Aside from the "alienation", he wasn't able to support us or even bothered to. He is the kind who only thinks of himself and does not think of a married guy, overall an irresponsible guy and has some vices on the side.I tried keeping our family together because of my son but he never tried. Even today he rarely goes and sees my son or gives him support. I reached the point where I don't care anymore. It would only stress me out.I would like to get out of the marriage which doesn't feel like a marriage in the first place. Is this a reasonable ground? Please advise me. Thank you for your time.

You may consider filing a Petition for Declaration of Nullity of Marriage at the Regional Trial Court at your place of residence in the Philippines.  The ground usually used for this type of case is Psychological Incapacity under Article 36 of the  Family Code. You may reach us for further discussions at our website or visit our profile and send us a message
