Hi, this is Atty. Roque. Yes, you may file an annulment of your marriage. For a background, an annulment is a legal process that declares a marriage null and void, effectively stating that the marriage was invalid from the beginning. It requires proving the existence of specific grounds recognized by the law of the jurisdiction where you reside. Grounds to nullify your marriage  can include fraud, lack of capacity, or consent, and thr most common ground is psychological incapacity.

The duration and cost of an annulment process can vary greatly depending on several factors, such as the complexity of your case, venhe where the case will be filed, availability of witnesses, among others. It is advisable to consult with a qualified family/annulment lawyer to get accurate information on the specific time frame and cost estimate relevant to your case.

A case for annulment or a declaration of nullity of marriage is filed at the Regional Trial Court of the place of your residence or that of your spouse in the Philippines. The ground usually used as basis is Psychological Incapacity under Article 36 of the Philippine Family Code. Psychological Incapacity means the failure to understand and comply with the essential marital obligations of living together and observing mutual love, respect and fidelity owing to a psychological cause. The manifestations of psychological incapacity range from sexual abuse or infidelity, physical or psychological abuse, sexual perversion, homosexuality, abandonment, refusal to give support, refusal to cohabit, drug addiction, alcoholism, excessive jealousy and extreme indolence, among other things.

It would  be ideal if you could furnish us the details of the case so we could provide a more definitive assessment and advice.
