An annulment case is decided by the court based on the evidence presented.  If the judge finds the case meritorious, then a decision is rendered annulling the marriage or declaring it null and void.  The duration of a case depends on numerous factors and would vary from case to case.  The respondent (your spouse) need not appear in court or participate in the court proceedings. However, it is necessary that he/she be informed of the case and served the corresponding Summons to comply with due process and jurisdictional requirements. The case would still proceed even if he/she does not file an Answer or appear in court.
