Asking Courts Permission To Take Your Child From The Mother For Better Schooling Opportunities Elsewhere

In South Africa

Last Updated: Jul 22, 2024

I have a 10 year old daughter which I've provided for even before she was born. I continue to look after her and cater for her best as I can. I was never married to the mom, we were dating briefly in varsity when she was conceived. However in 2017-2019 when I was in another relationship and got married, I had to approach the courts to get access to have my daughter come and visit me, to which was succesful. I approached the Mom and Grandmother lastyear to which they seemed amenable initially until they started ignoring me at the end of the year to request I take the child and school her and bring her up in Pretoria where there are more schooling opportunists supported by an array of sporting codes she could be involved in but also allow her to attend to any extra lessons which may be deemed neccessary to give her a better chance at school. My daughter is currently schooling in CarletonVille and she's generally intelligent however you can tell that with maybe taking her to a better school and allowing her greater community she can excel further. My daughter is currently 10, she can hardly read nor pronounce spelling words much. I cannot allow myself to not fight to give her a better chance if I can for the sake of good relations. She is currently living with her Grandmothers house with her mom in CarletonVille. I'm currently living in Pretoria with her twin brothers. She loves her brothers to the core and get along very well. They also listen more to her than they do to us as parents. At night, the twins will leave their beds and go sleep with her, in the mornings you find them all in one bed. Would I be eligible to request the courts to allow me to take my child and enroll her in better schools around Pretoria whereas on some weekends and school holidays she can go to CarletonVille? Engaging the mom any further Ja currently pointless as she sees red (violence) when I bring up the issue. Kindly advise how best I can come right on this matter without having to try engage her anymore.
