Recovery of debt based on a written deed agreement in Dhaka
In mid-2025, I entered into a formal written deed agreement with one of my friends for a personal investment of 75,000 BDT. The agreement stipulated that the amount would be repaid in monthly installments over 12 months, totaling a return of 82,500 BDT.
Current Situation (January 2026):
Nearly four to five months have passed since the agreement was signed. Despite the monthly installment plan, the debtor has only paid a total of 2,000 BDT. The payment was made in cash, but I have WhatsApp chat history where the debtor acknowledges the total amount owed and the small payment made to date. The debtor is currently unresponsive and ignoring the terms of the deed.
Evidence Available:
- Original written deed agreement.
- Digital records/WhatsApp conversations confirming the debt and partial payment.
My Goal/Questions:
1. What is the process for sending a formal legal notice in Dhaka to demand the outstanding 82,500 BDT?
2. Since I have a written deed but no bank cheques, is a “Money Suit” in a Civil Court the most effective route, or can I file a criminal case for breach of trust?
3. How can I use digital chat history as evidence in the Dhaka District Court?
4. What are the estimated legal fees for recovering a debt of this specific size?
