This last months AdamLaw has received several approved applications for Right of Residence Card (Uppehållskort) with 5 years validity for family members to EU-citizens. Nothing unusual about that until we add the fact that the "EU-citizens" are Swedish citizens and the applications made to the Swedish Migration Agency to legalize residency in Sweden.
For all you who have heard about the ruling C-370/90, also known as "Surinder Singh", this in not unheard of at all. An EU-citizen who activates his rights to freedom of movement, living at least three months in another EU-country an resettles is his home EU-country has the right to bring a third country national family member back as a family member to an EU-Citizen, thus not having to go through the national migration laws much longer and much more investigatory application process for a residence permit.
The case we present here is worth mentioning because the client was unaware of the possibility and was seeking legal guidance for an upcoming application for residence permit through the national rules, with its extensive processing times and issues regarding living apart for the process due to being unable to apply from within Sweden.
During the consultation the clients travel history opened up to advice the "Surinder Singh Route" instead. All said and done, we assisted the client down this path and without the happy couple being forced apart (You are allowed to stay during the application process), a couple of weeks later the family member now has the legal right to stay in Sweden for 5 years and will become permanent automatically!
