If you believe your Serbian lawyer failed to disclose a conflict of interest, you may file a disciplinary complaint with the Disciplinary Prosecutor of the relevant bar association. The complaint must be submitted in writing and should identify the lawyer, briefly describe the factual background of the representation, explain the circumstances that constitute the alleged conflict of interest, and include any supporting documentation available. Once the complaint is submitted, the Disciplinary Prosecutor conducts a preliminary review to determine whether the allegations, if true, could constitute a breach of professional or ethical duties. If the complaint is manifestly unfounded or outside the Bar’s jurisdiction, it may be dismissed at this stage, typically with written notice to the complainant. If the complaint discloses potential misconduct, the Disciplinary Prosecutor will request a written response from the lawyer and may collect additional information or evidence. Based on this review, the prosecutor will either dismiss the complaint or initiate formal disciplinary charges by referring the matter to the Disciplinary Court of the Bar Association.
