Common questions
What if the four-month registration period has passed?
Under section 25 of the Registration Act, a document executed in India may be accepted up to four months late if urgent necessity or unavoidable accident caused the delay, with a fine up to ten times the proper registration fee. An application may be lodged with the Sub-Registrar, who forwards it to the Registrar. [2]
Can someone represent me at registration?
Section 32 permits an agent duly authorised by a power of attorney executed and authenticated as section 33 requires. Where the Act is in force, section 33 provides for execution before and authentication by the Registrar or Sub-Registrar for the principal's residence. For a principal residing outside India, it recognises execution before and authentication by a notary public, court, judge, magistrate, Indian consul or vice-consul, or Central Government representative. [2]
What should I do if registration is refused?
Request the written reasons immediately. Under section 72, refusal for reasons other than denial of execution can be appealed to the Registrar within 30 days of the order. If execution is denied, section 73 instead provides an application to the Registrar within 30 days. Following the Registrar's refusal under section 72 or 76, section 77 allows a civil suit within 30 days. [2]
What if the deed is signed outside Maharashtra?
If a chargeable deed is executed entirely outside Maharashtra, section 18 of the Maharashtra Stamp Act allows stamping within three months after it is first received in Maharashtra. This stamping period is separate from the registration deadline. [3] [2]
