Immigration

Decree Law 3 of February 22, 2008 is the one that governs immigration matters and is duly regulated by Executive Decree 320 of August 8, 2008. It is important that you always consult with us about the type of Immigration Status you wish to apply for, in order to indicate the specific requirements for each one of them, or to suggest the one that best suits your immigration needs.

It is also extremely important that you maintain your Regular Migrant status at all times . For your information, a Regular Migrant is a foreigner who has the permits required by Panamanian law to maintain a legal stay in the country, within any of the immigration categories contemplated by the Law. Avoid unnecessary sanctions and even deportation for not maintaining your Regular Migrant status. Remember that you can enter the country under Tourist Status, either with a Stamped Visa or with a Tourist Card for those countries that have a suppressed visa. The period to be under this status is 90 days .   Citizens of the Bolivarian Republic of Venezuela maintain a temporary measure of Stamped Visa for Multiple Entries and Exits that allows them to visit our country for periods of stay of a maximum of 30 days and which is valid for three years.  If you intend to extend your stay beyond this period allowed by law, you must change your Immigration Status to any of the Immigration Categories established in this law, which we define below, for which you must comply with the established requirements.   Do not violate immigration law by working illegally in the country .   Do not also leave the country and re-enter to renew your stay as a "tourist."   The Law stipulates that the length of stay in the country cannot indicate that you are working, therefore, any exit and re-entry into the country in less than 30 days will be analyzed by the Immigration Personnel, who may deny you entry if they consider that you are using a strategy to evade the law by being an irregular migrant .

Emploi et travail

The Right to Work is a Human Right contemplated in the National Constitution of the Republic of Panama. The relationship between Employers and Workers is subject to an economic subordination that is regulated by different laws, the Labor Code and the decrees that regulate it, including Executive Decree 17 of May 11, 1999, which establishes regulations regarding the hiring of foreigners; and other regulations that complement it.

As a contractual relationship, Labor Law aims to maintain a balance between the parties, in the event of potential conflicts that may arise due to the non-compliance of one of them with the stipulations that govern said relationship. Remember that what governs the contractual relationship has the force of law between the parties. Support in labor and social security matters requires advice on all issues.

Individual employment contracts must be clear and include each of the requirements established by the Labor Code (salary, work hours, overtime pay, etc.), so as not to allow loopholes that harm the parties.

Other advice includes relations with unions, negotiation of collective bargaining agreements, strikes, occupational risks, calculations of rights and labor benefits, as well as ways to establish disciplinary sanctions and how to terminate an employment relationship.

Our services include:

  • Drafting and reviewing employment contracts
  • Advice on Employment Relationships
  • Representation in Labor Litigation on the part of both the Worker and the Employer
  • Verification of Employment Benefits
  • Work Permit Procedures for Hiring Foreigners
  • Preparation of Consultations with the Ministry of Labor
