Can I sue a Portuguese supplier for late deliveries and lost sales under our contract?

My company in Portugal has a written supply contract with delivery deadlines, but they keep delivering weeks late. We’ve lost clients and had to refund orders, and the supplier refuses to compensate us. What claims and evidence would we need to pursue damages in court or through a faster procedure?

In a situation like this, late deliveries in breach of agreed deadlines may qualify as contractual non-performance, giving rise, in general terms, to claims for damages (including lost profits and direct losses), as well as other remedies such as contract termination, price reduction or enforcement of penalty clauses, depending on the contract.

The success of any claim will largely depend on the contractual framework, the evidence of repeated delays, and the ability to demonstrate a clear causal link between those delays and the losses suffered (refunds, lost clients, additional costs).

Given the legal and evidentiary complexity of these cases, we would recommend a targeted legal assessment. Our team of specialist lawyers in commercial and contractual litigation can review the contract, assess the available evidence, and advise on the most effective strategy, including whether court action or a faster alternative procedure is appropriate.

We would be pleased to schedule a confidential consultation to analyse the case in detail.
