私は両親に代わって質問しています。 祖母は末期の脳腫瘍で、完全に体調を崩す前に家を売却し、母に財産管理委任状を与えました。家の売却代金は祖母名義の口座に振り込まれました。 そのお金は、祖母が私たちと同居していた間のあらゆる費用に使われました。症状が進行して介護施設に入所した際には、家の売却代金がその費用や、医療保険がカバーしなかった薬代にも充てられました。 祖母は1月10日に亡くなり、今になって、残るもう一人の兄弟姉妹が母を訴えてそのお金を取り戻そうとしています。 彼らは祖母が家の売却でいくら受け取ったかを把握しており、計算して亡くなった後にどれだけの額を期待できるかを算出していました。ところが、実際の額がその期待よりもかなり少なかったため、差額を請求するために私たち家族を訴えようとしています。 私の本当の質問は、母が祖母の財政を委任されていた代理人であったことを踏まえ、彼らには何か主張できる根拠があるのか、そして叔父と叔母に対抗するために両親ができる対策は何か、ということです。
