About Labor Law in Dubai, United Arab Emirates

The Labor Law in Dubai, United Arab Emirates, made up of Federal Law No. 8 of 1980, with various amendments, regulates labor rights and duties in the Emirates. It strictly governs all aspects of the employer-employee relationship, including compensation, benefits, working hours, vacation and leave policies, worker safety, and the terms of termination. The Law also includes specific provisions for female and juvenile workers. Non-UAE nationals also have the right to work in the UAE, provided they hold a valid employment visa.

Why You May Need a Lawyer

Legal assistance may be necessary in various circumstances. If you're an employee and believe that your rights are being infringed upon – for example, if you're not being paid overtime, if you've been unfairly dismissed, or if your workplace conditions are unsafe – you may need a lawyer to understand your rights and represent you. Employers may also require legal guidance to ensure they comply with the labor laws, including when drafting contracts, dealing with labor protests, or dealing with allegations of workers' rights infringements.

Local Laws Overview

Key aspects of Dubai’s Labor Law include working hours, where the maximum is usually eight hours per day, or 48 per week. However, these may be extended in certain professions. Paid maternity leave is a right for female employees, and termination of an employee's duties has to be justified and can lead to end-of-service benefits. Non-compete clauses are considered valid, but subject to certain conditions. An employment contract must be drawn up in a language understandable to the worker, and the employer is responsible for medical insurance coverage for all of their employees. Lastly, the law also entitles employees to an annual leave and public holidays.

Frequently Asked Questions

Are the laws the same for Free Zones?

While general UAE Labor Laws apply to all regions within the UAE, including the Free Zones, there are specific differences and exceptions with regards to certain aspects of labor law in Free Zones. It is wise to consult legal advice in these cases.

Can an employee work part-time?

Yes, workers in the UAE can be employed on a part-time basis. They must obtain a part-time work permit from the Ministry of Human Resources and Emiratisation.

What are the laws regarding unfair dismissal?

A worker can consider terminating the contract if the employer breaches the terms of contract or Labor Law. In cases where the employee has been arbitrarily dismissed, they may be entitled to compensation.

Does the law cover migrant workers?

Yes, the Labor Law also applies to non-UAE nationals who hold a valid work permit. They are entitled to the same rights and protections as UAE nationals.

What is the procedure to file a dispute?

If there's a dispute between the employer and the employee, the Ministry of Human Resources and Emiratisation should be notified in writing within one year of the dispute arising. The Ministry will try to settle the dispute amicably. If this does not work, then it may end up in court.

Additional Resources

The UAE Ministry of Human Resources and Emiratisation provides a host of online services and downloadable guides that can be very useful for gaining an understanding of the country's labor laws. In addition, the Dubai Courts website possesses information on labor disputes and procedures.
