Is adverse possession law still exist
Land Use & Zoning
Real Estate
Yes, adverse possession is still in effect in Kenya under the Limitations of Actions Act, Laws of Kenya. A person cannot sue to reclaim land after 12 years have passed since they first had the right to do so. This 12-year period starts either: When the person themselves first gained the right to claim the land, or when the person they inherited the right from first gained that right. There are some conditions however which need to be fulfilled which are: the person claiming adverse possession must prove and demonstrate that he has occupied the land openly, that is without secrecy, without force, and without license or permission of the landowner, with the intention to have the land.

If the provincial road was straightened and your property now lacks direct access, you might have a legal claim for a right of way along the original lines if it is the most practical route to access your property. When a provincial road is realigned, typically, there should be provisions to ensure that properties affected by the change maintain access to the public road. The local government should have a record of the realignment and any easements established as a result

About Land Use & Zoning Law

Land Use and Zoning Law is a branch of law that governs how land can be used in different areas, balancing private property rights with the public good. These laws dictate the kinds of buildings that can be developed, how those buildings can be used, and the overall planning of lands in urban, suburban, and rural areas. Zoning ordinances, a fundamental component of this field, categorize land into zones such as residential, commercial, industrial, and agricultural, each with its specific regulations.

Why You May Need a Lawyer

Legal assistance in Land Use and Zoning may be necessary for various situations:

  • Property Development: If you are planning to develop or redevelop property, you might need a lawyer to guide you through zoning laws, obtain permits, or challenge restrictions.
  • Rezoning Requests: Engaging a lawyer could be vital if you seek to change the zoning classification of your property to better suit your intended use.
  • Dispute Resolution: Land use disputes, whether with neighbors or municipal authorities, often require legal intervention to protect your interests.
  • Environmental Compliance: Ensuring that your planned land use complies with environmental regulations might necessitate expert legal advice.
  • Eminent Domain Issues: Legal help is often needed when government authorities propose to take over private land for public use.

Local Laws Overview

Local laws in Land Use and Zoning are primarily established by municipalities and vary significantly from one location to another. Key aspects to consider include:

  • Zoning Categories: Familiarize yourself with local zoning categories (e.g., residential, mixed-use, commercial) and their specific regulations in your area.
  • Permitting Process: Most construction or modification requires obtaining permits; knowing the local permitting process is crucial.
  • Planning and Development Codes: These set forth guidelines for urban planning, affecting how land can be developed or redeveloped.
  • Historic Preservation Ordinances: Some areas have laws designed to protect historic sites which can influence your property’s usability.
  • Setbacks and Density Regulations: These define how far structures must be from property lines and the density of buildings in an area.

Frequently Asked Questions

What is the purpose of zoning laws?

Zoning laws regulate land uses to promote health, safety, and the general welfare of the public by ensuring that there is harmony between developments in an area and the public interest.

Can zoning laws be challenged?

Yes, zoning laws can be challenged through variances, rezoning requests, or legal actions if believed to be unfair or improperly applied.

What is a variance in zoning law?

A variance is a request to deviate from current zoning requirements, often granted when strict enforcement would cause unnecessary hardship due to unique property circumstances.

How does one apply for a zoning change?

Applying for a zoning change typically involves submitting a proposal to your local zoning board or planning commission, often followed by public hearings.

What is an easement, and how is it relevant to zoning?

An easement is a legal right to use another’s land for a specific purpose, like utilities or access; it can influence how property can be developed or used.

How do I know if my property is in a flood zone?

Your local government or a visit to the FEMA Flood Map Service can provide data on flood zones, which can impact building and insurance requirements.

What are height restrictions in zoning laws?

Height restrictions dictate the vertical size of buildings to maintain an area’s aesthetic, light, air, and structural safety.

Is it possible to have mixed-use zoning?

Yes, mixed-use zoning allows a combination of residential, commercial, and sometimes industrial uses in one zone, promoting diverse development.

Why would a promise from a previous landowner not exempt me from zoning laws?

Land use rights and obligations persist despite ownership changes unless proper legal steps have been undertaken to transfer or amend those rights.

What happens if I violate zoning laws?

Violating zoning laws can result in fines, forced removal of structures, or cessation of offending activities, and legal assistance may be necessary to resolve such matters.
